1. Confirmation and Acceptance of Service TermsIn order to meet your needs for purchasing LingoMate APP membership continuous subscription service and automatic deductions, Hangzhou Feizhu Technology Co., Ltd. has introduced the continuous subscription service. Please refer to the terms of this agreement for relevant services. If you wish to purchase, click on the "Continuous Subscription" option to purchase the product. This agreement constitutes a prerequisite for your use of the continuous subscription service provided by Hangzhou Feizhu Technology Co., Ltd. Unless you accept the terms of this agreement, you have no right to use this service. Your choice to use this service will be deemed as agreeing to be bound by this agreement. When you use the continuous subscription service, your use will be deemed as agreeing to the relevant terms of the individual service and various notices issued by Hangzhou Feizhu Technology Co., Ltd. in that individual service.
2. Ownership and Usage Rights
All ownership and related intellectual property rights of the network services involved in the continuous subscription service are owned by Hangzhou Feizhu Technology Co., Ltd. and are legally protected by the laws of the People's Republic of China and international conventions. You do not automatically acquire any or all of the aforementioned rights by using the continuous subscription service. In addition, Hangzhou Feizhu Technology Co., Ltd. may modify any or all of the terms in this service agreement or adjust the continuous subscription service based on statutory requirements or the "Terms of Use and Copyright Statement." For such modifications or adjustments, Hangzhou Feizhu Technology Co., Ltd. will announce them on the website and they will take effect 7 days after the announcement. Hangzhou Feizhu Technology Co., Ltd. strongly advises you to regularly check the "Terms of Use and Copyright Statement" and the terms under this agreement. If you find that the adjustments made by Hangzhou Feizhu Technology Co., Ltd. are unacceptable, please terminate the relevant services provided by Hangzhou Feizhu Technology Co., Ltd. in a timely manner, especially the use of this continuous subscription service.
3. Types of Continuous Subscription Services and Scope of Service Content
Hangzhou Feizhu Technology Co., Ltd.'s continuous subscription service currently includes continuous monthly and continuous yearly types, and new continuous subscription services will be continuously added based on user needs. By using the continuous subscription service, you can regularly obtain the following LingoMate membership services:
VIP membership services, including: professional rating system, personalized display of works, dubbing reports, etc. For more detailed membership service content, please refer to the VIP membership privileges in the LingoMate APP.
Unless notified otherwise by Hangzhou Feizhu Technology Co., Ltd., the effective period of the above-mentioned LingoMate membership services is calculated in natural days. For continuous monthly users, the effective period of each renewal is calculated in days of natural month.
4. Service Description
4.1 This service is provided to meet your need for automatic renewal. Under the condition that you have subscribed to this service, it aims to prevent any loss caused by your negligence or other reasons leading to failure in timely renewal. You authorize Hangzhou Feizhu Technology Co., Ltd. to deduct the fees for the next billing cycle from the member's own recharge account, third-party payment account bound to the member's account, bank card, and communication account (collectively referred to as the "account") when your current LingoMate membership is about to expire. The realization of this service is based on the premise that you have bound your LingoMate membership account to the aforementioned account and can successfully deduct funds from it.
4.2 Automatic renewal specifically refers to the deduction method where Hangzhou Feizhu Technology Co., Ltd. collects the fees for the next billing cycle of LingoMate membership continuous subscription products through the aforementioned account based on the premise of 4.1. You need to ensure that Hangzhou Feizhu Technology Co., Ltd. can deduct the fees from the aforementioned account successfully. If the renewal fails due to insufficient balance in the aforementioned account, you will bear the responsibility.
4.3 In case of errors during the deduction process, Hangzhou Feizhu Technology Co., Ltd. and you should cooperate closely to investigate the reasons, and each party shall bear the losses caused by its own faults. If losses are caused by unequal faults of both parties, both parties shall bear corresponding responsibilities based on the degree of fault; if both parties are jointly responsible, the responsibility shall be shared by both parties.
4.4 The services provided by Hangzhou Feizhu Technology Co., Ltd. to you are limited to use within the LingoMate APP. Any payment outside of LingoMate APP or any act of separating the content provided by Hangzhou Feizhu Technology Co., Ltd. from LingoMate APP through malicious cracking or other illegal means is not covered by the agreement. All legal consequences arising from such acts shall be borne by the actor, and Hangzhou Feizhu Technology Co., Ltd. will pursue the legal responsibilities of the actor according to the law.
5. Activation of Continuous Subscription Service
5.1 If you activate this service from the iOS end, it is deemed that you authorize Hangzhou Feizhu Technology Co., Ltd. to deduct the service fees for the next billing cycle from your iTunes account balance when your LingoMate VIP membership is about to expire. The billing cycle includes, but is not limited to, monthly cycles.
5.2 For the selected payment channel, you are obligated to ensure that you regularly check and ensure that there is sufficient balance under the account of the payment method for the application of continuous subscription service. If there are defects (including but not limited to insufficient balance, insufficient balance to meet the user's choice of multiple continuous subscription services) due to the aforementioned reasons, leading to the inability to meet the application of continuous subscription service, Hangzhou Feizhu Technology Co., Ltd. has the right to temporarily suspend the LingoMate VIP membership service accessed through continuous subscription service.
6. Validity Period of Continuous Subscription Service
Unless specified otherwise by Hangzhou Feizhu Technology Co., Ltd., the continuous subscription service you obtain is valid for a long period.
Unless otherwise specified by Hangzhou Feizhu Technology Co., Ltd., the continuous package services you obtain are considered long-term valid. Hangzhou Feizhu Technology Co., Ltd. will send you a renewal reminder for the continuous package service through SMS, in-app messages, WeChat public account, or other means before the expiration of the LingoMate VIP membership service period you selected. If you do not confirm the information or if the confirmed information does not fully comply with the system requirements of Hangzhou Feizhu Technology Co., Ltd., Hangzhou Feizhu Technology Co., Ltd. has the right to consider your entrustment to renew the service fee through your default payment method.
This service is at your discretion to cancel or not. If you choose not to cancel, it will be deemed that you agree to Hangzhou Feizhu Technology Co., Ltd. conducting periodic deduction attempts in accordance with this agreement. Once the deduction is successful, LingoMateAPP will activate the continuous package service for your next billing cycle. If the price of the LingoMateVIP membership package service changes during or before the automatic renewal, the current valid price should be applied.
Hangzhou Feizhu Technology Co., Ltd. reminds you that by choosing to use the continuous package service and entrusting LingoMateAPP to pay the fees through your default payment method, you are considered to have subscribed to the relevant paid services of LingoMateAPP. Therefore, Hangzhou Feizhu Technology Co., Ltd. will not refund the fees you have paid in any way.
7. Unsubscribing from Continuous Subscription Service
7.1 You can choose to unsubscribe from this service on your own.
7.2 Termination process, i.e., steps to close the continuous subscription membership service:
a. For continuous subscription products opened using your Apple ID, go to "Settings" → "iTunes & App Store" → "Apple ID" → "View Apple ID" → Click on "Subscriptions" on the account settings page → Cancel LingoMate VIP membership subscription.
Friendly reminder: After the successful cancellation of the continuous subscription package, it will not affect the valid membership rights of the current period. The membership rights will not be renewed after expiration.
The instructions you have entrusted to Hangzhou Feizhu Technology Co., Ltd. for continuous subscription deduction before choosing to terminate this service are still valid. LingoMate APP will not refund the fees deducted based on this instruction.
8. Privacy Policy
In order for you to have a better experience with this service, it may collect your corresponding personal information. However, Hangzhou Feizhu Technology Co., Ltd. attaches great importance to the protection of user personal information. Please refer to the "Privacy Protection Guidelines" of Hangzhou Feizhu Technology Co., Ltd. for detailed personal information policies. If you do not agree, please do not open or stop using this service.
9. Agreement Validity Period and Termination
This agreement shall take effect from the date you choose to accept or use this service until you terminate this service/cancel your membership.
10. Dispute Resolution and Applicable Law
Hangzhou Feizhu Technology Co., Ltd. and you should resolve disputes arising from the performance of this agreement through friendly negotiation. If a dispute cannot be resolved through negotiation, either party has the right to submit the dispute to the people's court in the location of the defendant for litigation resolution. The interpretation, validity, and execution of this agreement are governed by the laws of the People's Republic of China.
